2. Eligibility & Age Restriction

You must be at least 18 years of age to use Tracom. By accessing or using the Platform, you represent and warrant that you are 18 or older and have the legal capacity to enter into a binding agreement.

3. Account Registration

• Accuracy: You agree to provide current, accurate, and complete information during registration and keep it updated.
• Responsibility: You are responsible for maintaining the confidentiality of your account credentials and restricting access to your devices.

4. Use of the Platform

• License: We grant you a non-exclusive, non-transferable, revocable license to access and use Tracom in accordance with these Terms.
• Prohibited Conduct: You agree not to misuse the Platform by engaging in illegal activities, transmitting harmful code, or infringing on any intellectual property rights.

5. Subscription to Other Users & Platform Fees

Certain Tracom users offer subscription-based services (“Creators”) that other users (“Subscribers”) can pay for. We collect a 15% platform fee on such subscription transactions. The payment process is handled by Stripe, not directly by Tracom.

• No Refunds: All payments made through the Platform are final and non-refundable.
• Stripe Terms: Use of Stripe’s services is subject to Stripe’s own terms of service and privacy policy.

6. Disclaimer – No Financial Advice

Tracom is not a financial advisor and does not provide financial advice. Any content related to finances or investments is purely for informational purposes. You acknowledge and agree that you are solely responsible for any decisions or actions you take based on the information available on the Platform. You should consult a licensed financial advisor before making any financial decisions.

7. Intellectual Property

All trademarks, service marks, logos, and intellectual property displayed on Tracom are the property of Tobistech Ltd or their respective owners. You are not granted any rights to use them without explicit written permission.

8. Limitation of Liability

To the maximum extent permitted by law, Tobistech Ltd and its affiliates, directors, employees, and agents shall not be liable for any indirect, consequential, incidental, special, or punitive damages arising out of your use of or inability to use Tracom. This includes any decisions or transactions made based on the content provided on the Platform.

9. Indemnification

You agree to defend, indemnify, and hold harmless Tobistech Ltd from and against any claims, liabilities, damages, judgments, awards, losses, and expenses (including legal fees) arising out of or in connection with your use of the Platform or any breach of these Terms.

10. Termination

We reserve the right to suspend or terminate your access to Tracom at any time, without notice, for any or no reason, including if we believe you have violated these Terms.

11. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United Kingdom. Any disputes arising out of or related to these Terms shall be resolved in the courts of the United Kingdom.

12. Changes to Terms

We may update or modify these Terms at any time. The updated version will be posted on the Platform, and your continued use of Tracom after posting constitutes acceptance of the changes.
