Terms of Service
Please read these terms carefully before using Tracom, including AI-generated trade ideas, market analysis and trading journal features.

1. Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Tobistech Ltd (Company No. 16037879), a company registered in England and Wales ("Company," "we," "us," or "our"), concerning your use of the Tracom mobile application and related services (collectively, the "Service").
By downloading, accessing, or using Tracom, you agree to be bound by these Terms. If you disagree with any part of these Terms, you must immediately discontinue use of our Service.
2. Eligibility and Registration
2.1 Age Requirements
You must be at least 18 years old to use Tracom. By using the Service, you represent and warrant that you:
Are at least 18 years of age
Have the legal capacity to enter into binding contracts
Are not prohibited from using the Service under applicable laws
2.2 Account Registration
To access certain features, you must register for an account. You agree to:
Provide accurate, current, and complete information
Maintain and update your information to keep it accurate
Maintain the security of your password and accept all risks of unauthorised access
Notify us immediately of any unauthorised use or security breach
Accept responsibility for all activities under your account
2.3 Account Restrictions
You may not: (i) select or use a username of another person with intent to impersonate; (ii) use a username subject to rights of another without authorisation; or (iii) use a username that we deem offensive or inappropriate.
3. Description of Service
Tracom is a trading journal, risk management and AI-powered market analysis application that provides tools to help traders log trades, manage risk, review performance, and understand market conditions.
3.1 Core Features (Free)
Personal trading journal for logging trades and notes
Risk and position size calculators
Performance analytics and reporting
Cloud synchronization across devices
Data export capabilities (such as CSV or PDF, where supported)
Limited access to AI-driven market review and market commentary summaries for educational use
Contextual market information, including selected economic indicators and fundamentals, where available
3.2 AI Insights, Trade Ideas and Market Data (Where Available)
Depending on your subscription plan, device, and location, Tracom may provide additional insight and data features, including:
AI-generated market review, bias and commentary based on price action, news and other data sources
AI-generated trade ideas with illustrative example entry zones, stop-loss and take-profit levels
Real-time or near real-time economic event calendars and related contextual information
Fundamentals snapshots for supported assets (for example, earnings per share, price-to-earnings ratios, dividends and market capitalization)
Tools that help you interpret your trading performance, risk exposure and market conditions in one place
AI outputs and market data are informational and should not be treated as personalised investment advice, financial promotion, or a guarantee of performance.
Note: Features may vary based on your location, subscription level and applicable laws. We reserve the right to modify, suspend, or discontinue any feature at our discretion.
4. Account Security and Responsibility
You are responsible for safeguarding your account. We implement industry-standard security measures, but cannot guarantee absolute security.
You agree to:
Use a strong, unique password for your account
Enable two-factor authentication when available
Never share your login credentials
Log out from shared devices
Report suspicious activity immediately
Warning: You are solely responsible for any activity on your account, whether authorised or not. We are not liable for any loss or damage from unauthorised account access.
5. User Content and Rights
5.1 Your Content
You retain ownership of content you create ("User Content"), including trade logs, notes, analysis and any other information you record in the app. By using the Service, you grant us a worldwide, non-exclusive, royalty-free licence to use, store, and display your User Content solely for providing and maintaining the Service, including generating AI outputs in direct response to your requests within the Service. We do not use your personal trading data to train AI models without your separate express consent.
5.2 Content Standards
Your User Content must not:
Contain false, misleading, or deceptive information presented as factual performance data
Violate any laws or regulations
Infringe on intellectual property rights
Constitute financial advice without proper disclaimers where applicable
Contain malware, viruses, or harmful code
Harass, threaten, or harm others
5.3 Public Content
If you choose to make content public or share it with subscribers (where such features are offered), you understand that: (i) others may view, copy, and use your content; (ii) we are not responsible for others' use of your public content; (iii) you should not share sensitive or confidential information publicly; and (iv) you are responsible for ensuring that any content which could be viewed as financial promotion complies with applicable laws and regulations.
6. App Subscriptions, Monetisation, and Payments
6.1 Tracom Premium Subscription
Tracom offers optional premium subscriptions with enhanced features:
Free Version Includes:
• Basic trade journaling
• Risk and position size calculators
• Limited analytics and reporting
• Limited access to AI market review and commentary summaries
• Limited access to economic and fundamentals data
• Advertisements (Google AdMob)
Premium Version Includes:
• Ad-free experience
• Higher or unlimited trade entries (subject to fair use)
• Advanced analytics, filters and performance reports
• Extended access to AI-generated trade ideas, market review and risk insights
• Extended economic and fundamentals data, where supported
• Priority customer support
• Access to upcoming enhancements before wider rollout
• Expanded data export options where available
Pricing: Premium subscriptions are billed through Apple App Store or Google Play Store at their listed prices, which may vary by region and include applicable taxes.
6.2 Creator Monetisation (Where Offered)
In certain regions and account types, premium users may be able to monetise their content by offering subscription access to journals, analysis or other materials. Where this functionality is available, additional terms and onboarding steps may apply.
Revenue Split: Where Stripe or similar processors are used, Tracom may charge a platform fee (for example, 15%) plus applicable payment processing fees. Exact fee structures and payout terms will be shown in-app or in separate documentation, and may vary by country, currency and payment method.
6.3 Payment Processing
App Premium: Processed through Apple App Store or Google Play Store
Creator Monetisation (if available): Typically processed through Stripe or other approved payment providers
By making payments, you agree to the respective payment processor's terms of service and privacy policies. We do not store credit card information on our servers.
6.4 Refunds and Cancellations
Important: Refund policies differ by subscription type.
App Premium: Subject to App Store/Google Play refund policies
Creator Subscriptions (if available): Typically non-refundable once processed, except as required by law
Cancellation: Cancel anytime through your device settings or account settings
Access: Premium features continue until the end of the billing period
Auto-renewal: Subscriptions auto-renew unless cancelled 24 hours before the period ends
UK & EU Consumers - Statutory Cancellation Right: If you purchase a Tracom subscription directly through our platform (not through an app store), you may have a 14-day statutory right to cancel. Please see our Refund Policy for full details, including how to exercise this right and when it may be lost.
UK Direct Subscriptions - Digital Markets, Competition and Consumers Act 2024 (DMCCA 2024): For subscriptions billed directly through our platform (for example, creator subscriptions processed via Stripe), additional rights apply under the DMCCA 2024:
• Pre-renewal reminder: We will notify you before your subscription renews, giving you the opportunity to review and cancel.
• Post-reminder cooling-off: You have 14 days from receiving the pre-renewal reminder to cancel without incurring the renewal charge.
• Easy cancellation: You can cancel your direct subscription at any time through the Tracom app settings.
Note: The 24-hour cancellation rule above applies only to App Store and Google Play subscriptions, which are managed and governed by Apple and Google respectively.
6.5 Tax Responsibilities
For Users: App store prices may include applicable taxes charged by Apple or Google.
For Creators: You are responsible for tax obligations on earnings. We may provide required tax documentation when legally obligated, based on your jurisdiction and earnings threshold.
7. Advertising and Data Collection
7.1 Google AdMob Advertising
The free version of Tracom displays advertisements provided by Google AdMob. By using the free version, you acknowledge that:
Ads are shown to support free access to the app
For users in the UK and EEA, Google's collection of data for ad serving (personalised or non-personalised) requires your separate consent, which will be sought through an in-app prompt before ads are shown
You can manage ad preferences at any time in your device settings
Ad content is not controlled or endorsed by Tracom
7.2 Ad Data Collection
Google AdMob may collect: device identifiers and IP address, ad interaction data, general location (country/city level), app usage statistics. For details, see Google's Privacy Policy.
7.3 Remove Ads
Go Premium: Subscribe to Tracom Premium for an ad-free experience plus extended analytics, AI tools and data. Available as monthly or annual subscription through your app store.
8. Prohibited Uses
You agree NOT to use the Service to:
Illegal Activities
• Violate any laws or regulations
• Facilitate money laundering
• Promote illegal trading activities
• Share insider information
Harmful Content
• Spread false information
• Manipulate markets
• Harass other users
• Share malicious code
Unauthorised Access
• Hack or breach security
• Scrape data without permission
• Use automated bots
• Circumvent access restrictions
Service Abuse
• Impersonate others
• Create fake accounts
• Sell or transfer accounts
• Interfere with the Service
Violation of these prohibitions may result in immediate account termination and legal action.
9. Trading and Financial Disclaimer

No Financial Advice: Nothing in Tracom constitutes financial, investment, legal, or tax advice
Educational Purpose: All content, including AI-generated trade ideas, market commentary and examples, is for informational and educational purposes only
No Guarantees: We make no guarantees about trading success, the performance of AI-generated trade ideas, or profitability
AI and Data Limitations: AI outputs, example stop-loss/take-profit levels, position size suggestions and market data may be delayed, incomplete, inaccurate or unavailable and should not be relied upon as a sole basis for trading decisions
User Responsibility: You are solely responsible for your trading decisions and their consequences
Consult Professionals: Always consult a qualified, regulated financial adviser before making investment decisions
Creator and Third-Party Content: Trading strategies, analysis and information shared by other users or third-party providers, as well as AI-generated summaries derived from such content, are personal opinions or automated outputs. We do not verify, endorse, or guarantee the accuracy, completeness or suitability of any such content.
10. Privacy and Data Protection
10.1 Data Processing
Your use of Tracom is also governed by our Privacy Policy. Your personal data is processed in accordance with our Privacy Policy and applicable data protection law. By using the Service, you acknowledge our data practices as described therein, including storage of data on servers in the United States (Virginia) or other locations disclosed in our Privacy Policy and international transfers made under the safeguards described therein.
10.2 AI Processing and Third-Party Providers
Certain features, including AI-generated trade ideas, market commentary and analysis, may rely on third-party AI models and market data providers. To deliver these features, we may send portions of your data (such as prompts, trade context or pseudonymised or aggregated identifiers where practicable) to such providers, in accordance with our Privacy Policy and applicable data protection laws.
10.3 Regional Compliance
🇪🇺 EU/EEA Users (GDPR): We comply with applicable GDPR requirements, including data subject rights, lawful basis for processing, and appropriate safeguards for international transfers.
🇺🇸 California Users (CCPA): California residents have specific privacy rights under the CCPA/CPRA, including the right to know, delete, correct, and opt-out of certain data practices.
🇬🇧 UK Users: We comply with applicable UK GDPR and Data Protection Act 2018 requirements.
11. Intellectual Property Rights
11.1 Tracom Property
The Service, including its original content, features, AI models configured by us, and functionality, is owned by Tobistech Ltd and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
11.2 Limited Licence
We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for personal, non-commercial purposes in accordance with these Terms, except that Creator accounts are additionally licensed to use the Creator Monetisation features in accordance with Section 6.2 of these Terms.
11.3 Restrictions
You may not:
Copy, modify, or distribute the Service's software
Reverse engineer or attempt to extract source code
Remove or alter proprietary notices
Use our trademarks without written permission
12. Termination
12.1 Termination by You
You may terminate your account at any time by: (i) Cancelling all active subscriptions; (ii) Requesting account deletion through the app or by contacting support; (iii) Ceasing all use of the Service.
12.2 Termination by Us
We may suspend or terminate your account, with reasonable notice where practicable, if:
You violate applicable laws
Your conduct harms other users or the Service
We discontinue the Service
Where immediate action is necessary to prevent fraud, security threats, harm to other users, or ongoing legal breach, we may suspend without prior notice. We will notify you as soon as reasonably practicable after such suspension.
Where we discontinue the Service, users with active prepaid subscriptions will be entitled to a pro-rata refund for any unused portion of their prepaid period.
12.3 Effect of Termination
Upon termination: (i) Your right to use the Service ceases immediately; (ii) You may forfeit any pending payouts if terminated for cause, only to the extent that those payouts directly arise from the activity or breach that gave rise to termination - payouts earned through legitimate, unrelated activity prior to the breach will not be withheld; (iii) We may delete your data after a reasonable period unless legally required to retain it; (iv) Provisions that by their nature should survive termination will remain in effect.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
No Consequential Damages: We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, data loss, or trading losses
Liability Cap: Our total liability shall not exceed the amount you paid to us in the 12 months preceding the claim
No Warranty: The Service is provided "AS IS" without warranties of any kind, either express or implied
Trading Losses: We are not responsible for any trading losses, missed opportunities, or financial decisions made based on the Service or any AI-generated outputs
Some jurisdictions do not allow limitation of certain warranties or damages, so some of the above limitations may not apply to you.
Consumer Rights Act 2015 (UK): Nothing in this section excludes or limits any implied terms that cannot lawfully be excluded under the Consumer Rights Act 2015, including the implied term that digital services will be supplied with reasonable care and skill. Your statutory rights are not affected.
14. Dispute Resolution
14.1 Governing Law
These Terms are governed by the laws of England and Wales, without regard to conflict of law principles. Nothing in this governing law clause limits any rights you have under the mandatory consumer protection laws of your country of habitual residence.
14.2 Informal Resolution
Before filing a claim, you agree to try to resolve disputes informally by contacting support@tobistech.co.uk. Most disputes can be resolved informally within 30 days. This informal step is without prejudice to your right to seek urgent relief from a court or to bring a claim immediately where circumstances require it.
14.3 Arbitration (Non-UK Users)
For users outside the UK and outside the European Union/EEA, disputes not resolved informally may be settled by binding arbitration in accordance with the London Court of International Arbitration (LCIA) rules, conducted in English. EU/EEA consumers are not subject to this clause and retain the right to bring claims in their local courts under §14.4 below.
14.4 UK and EU Users
UK and EU users may bring claims in their local courts as permitted by law. EU consumers may also seek assistance from the national consumer ADR body or disputes authority in their country of residence.
UK Consumers - Alternative Dispute Resolution: We are not obliged to participate in alternative dispute resolution, but if we are unable to resolve your complaint you may wish to seek advice from:
Citizens Advice - citizensadvice.org.uk (general consumer rights guidance)
Financial Ombudsman Service - financial-ombudsman.org.uk (if your complaint relates to financial services)
This does not affect your right to bring legal proceedings at any time.
Class Action Waiver: Subject to the consumer protection exception below, you agree to bring claims only in your individual capacity and not as part of any class or representative action.
UK & EU Consumer Exception: Nothing in this waiver limits any rights you may have under applicable UK or EU consumer protection laws to participate in collective redress schemes or representative actions available to consumers in your jurisdiction. This waiver does not apply to you to the extent it is unenforceable under mandatory consumer protection law.
15. International Use and Compliance
15.1 Global Availability
Tracom is available globally, but some features (including AI-generated trade ideas and market data) may be restricted or adjusted in certain jurisdictions due to legal, regulatory or commercial requirements. You are responsible for compliance with local laws.
15.2 Prohibited Jurisdictions
The Service is not available in countries subject to UK, EU, or US sanctions, or where prohibited by law. This includes but is not limited to: North Korea, Iran, Syria, Cuba, and the Russian-occupied territories of Ukraine (including Crimea, Donetsk, Luhansk, Zaporizhzhia and Kherson regions).
15.3 Export Controls
You agree not to export or re-export the Service to any country in violation of export control laws of the United Kingdom, European Union, United States, or other applicable jurisdictions.
15.4 Currency and Taxes
All prices are typically displayed in your local currency where supported. Otherwise, prices may be shown in USD or another reference currency. You are responsible for any taxes, duties, or customs fees imposed by your jurisdiction, except where we are legally required to collect them.
16. General Provisions
16.1 Entire Agreement
These Terms of Service, together with the Terms of Use, Privacy Policy, Cookie Policy, Disclaimer and any other policies expressly referenced herein, constitute the entire agreement between you and Tobistech Ltd regarding the Service and supersede all prior agreements, representations and understandings. In the event of any conflict between these Terms and the Terms of Use, these Terms of Service shall prevail.
16.2 Amendments
We may modify these Terms at any time. Material changes will be notified via email or in-app notification at least 30 days before taking effect. Where required by applicable consumer protection laws, we may give additional notice or seek fresh acceptance. If you do not wish to be bound by the updated Terms, you may close your account before the changes take effect. Where you have a prepaid subscription and choose not to accept the new Terms, you will be entitled to a pro-rata refund for any unused portion of your prepaid period.
16.3 Severability
If any provision is found unenforceable, the remaining provisions will continue in full force.
16.4 Waiver
Our failure to enforce any right or provision is not a waiver of that right or provision.
16.5 Assignment
You may not assign these Terms without our written consent. We may assign our rights to any successor or acquirer. Any such assignment will not reduce the rights and protections you have under these Terms or applicable consumer protection laws.
16.6 Force Majeure
We shall not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including acts of God, pandemic, war, government action, regulatory changes, internet or infrastructure failures, or third-party service outages. We will use reasonable efforts to minimise the impact and resume normal service as soon as practicable.
