Terms of Service

2.1 Age Requirements

You must be at least 18 years old to use Tracom. By using the Service, you represent and warrant that you:

• • Are at least 18 years of age
• • Have the legal capacity to enter into binding contracts
• • Are not prohibited from using the Service under applicable laws

2.2 Account Registration

To access certain features, you must register for an account. You agree to:

• • Provide accurate, current, and complete information
• • Maintain and update your information to keep it accurate
• • Maintain the security of your password and accept all risks of unauthorized access
• • Notify us immediately of any unauthorized use or security breach
• • Accept responsibility for all activities under your account

2.3 Account Restrictions

You may not: (i) select or use a username of another person with intent to impersonate; (ii) use a username subject to rights of another without authorization; or (iii) use a username that we deem offensive or inappropriate.

3.1 Core Features (Free)

• • Personal trading journal for logging trades and notes
• • Risk and position size calculators
• • Performance analytics and reporting
• • Cloud synchronization across devices
• • Data export capabilities (such as CSV or PDF, where supported)
• • Limited access to AI-driven market review and signal summaries for educational use
• • Contextual market information, including selected economic indicators and fundamentals, where available

3.2 AI Insights, Signals and Market Data (Where Available)

Depending on your subscription plan, device, and location, Tracom may provide additional insight and data features, including:

• • AI-generated market review, bias and commentary based on price action, news and other data sources
• • AI-generated trade ideas or signal suggestions with example entry zones, stop-loss and take-profit levels
• • Real-time or near real-time economic event calendars and related contextual information
• • Fundamentals snapshots for supported assets (for example, earnings per share, price-to-earnings ratios, dividends and market capitalization)
• • Tools that help you interpret your trading performance, risk exposure and market conditions in one place

AI outputs and market data are informational and should not be treated as personalised investment advice, financial promotion, or a guarantee of performance.

5.1 Your Content

You retain ownership of content you create ("User Content"), including trade logs, notes, screenshots, analysis and any other information you record in the app. By using the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, store, and display your User Content solely for providing, maintaining and improving the Service (including AI features that require access to such content as context).

5.2 Content Standards

Your User Content must not:

• • Contain false, misleading, or deceptive information presented as factual performance data
• • Violate any laws or regulations
• • Infringe on intellectual property rights
• • Constitute financial advice without proper disclaimers where applicable
• • Contain malware, viruses, or harmful code
• • Harass, threaten, or harm others

5.3 Public Content

If you choose to make content public or share it with subscribers (where such features are offered), you understand that: (i) others may view, copy, and use your content; (ii) we are not responsible for others' use of your public content; (iii) you should not share sensitive or confidential information publicly; and (iv) you are responsible for ensuring that any content which could be viewed as financial promotion complies with applicable laws and regulations.

7.1 Google AdMob Advertising

The free version of Tracom displays advertisements provided by Google AdMob. By using the free version, you acknowledge that:

• • Ads are shown to support free access to the app
• • Google may collect certain data for ad personalization
• • You can opt-out of personalized ads in your device settings
• • Ad content is not controlled or endorsed by Tracom

7.2 Ad Data Collection

Google AdMob may collect:

• • Device identifiers and IP address
• • Ad interaction data
• • General location (country/city level)
• • App usage statistics

7.3 Remove Ads

10.1 Data Processing

Your use of Tracom is also governed by our Privacy Policy. By using the Service, you consent to:

• • Collection and processing of your personal data as described in our Privacy Policy
• • Storage of data on servers located in the United States (Virginia) or other locations disclosed in our Privacy Policy
• • International transfer of data necessary for Service operation

10.2 AI Processing and Third-Party Providers

Certain features, including AI-generated signals, market commentary and analysis, may rely on third-party AI models and market data providers. To deliver these features, we may send portions of your data (such as prompts, trade context or anonymised identifiers) to such providers, in accordance with our Privacy Policy and applicable data protection laws.

We implement industry-standard security measures including encryption, secure servers, and regular security reviews. However, no method of transmission over the Internet is completely secure, and we cannot guarantee absolute protection.

11.1 Tracom Property

The Service, including its original content, features, AI models configured by us, and functionality, is owned by Tobistech Ltd and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

11.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes in accordance with these Terms.

11.3 Restrictions

You may not:

• • Copy, modify, or distribute the Service's software
• • Reverse engineer or attempt to extract source code
• • Remove or alter proprietary notices
• • Use our trademarks without written permission

11.1 Termination by You

You may terminate your account at any time by: (i) Canceling all active subscriptions; (ii) Requesting account deletion through the app or by contacting support; (iii) Ceasing all use of the Service.

11.2 Termination by Us

We may suspend or terminate your account immediately, without prior notice, if:

• • You breach these Terms
• • You violate applicable laws
• • Your conduct harms other users or the Service
• • We discontinue the Service

11.3 Effect of Termination

Upon termination: (i) Your right to use the Service ceases immediately; (ii) You may forfeit any pending payouts if terminated for cause; (iii) We may delete your data after a reasonable period unless legally required to retain it; (iv) Provisions that by their nature should survive termination will remain in effect.

13.1 Governing Law

These Terms are governed by the laws of England and Wales, without regard to conflict of law principles.

13.2 Informal Resolution

Before filing a claim, you agree to try to resolve disputes informally by contacting support@tobistech.co.uk. Most disputes can be resolved informally within 30 days.

13.3 Arbitration (Non-UK Users)

For users outside the UK, disputes not resolved informally may be settled by binding arbitration in accordance with the London Court of International Arbitration (LCIA) rules, conducted in English.

13.4 UK and EU Users

UK and EU users may bring claims in their local courts as permitted by law. EU users may also use the European Commission's Online Dispute Resolution platform.

14.1 Global Availability

Tracom is available globally, but some features (including AI, signals and market data) may be restricted or adjusted in certain jurisdictions due to legal, regulatory or commercial requirements. You are responsible for compliance with local laws.

14.2 Prohibited Jurisdictions

The Service is not available in countries subject to UK, EU, or US sanctions, or where prohibited by law. This includes but is not limited to: North Korea, Iran, Syria, Cuba, and the Crimea region.

14.3 Export Controls

You agree not to export or re-export the Service to any country in violation of export control laws of the United Kingdom, European Union, United States, or other applicable jurisdictions.

14.4 Currency and Taxes

All prices are typically displayed in your local currency where supported. Otherwise, prices may be shown in USD or another reference currency. You are responsible for any taxes, duties, or customs fees imposed by your jurisdiction, except where we are legally required to collect them.

15.1 Entire Agreement

These Terms constitute the entire agreement between you and Tobistech Ltd regarding the Service.

15.2 Amendments

We may modify these Terms at any time. Material changes will be notified via email or in-app notification at least 30 days before taking effect where legally required.

15.3 Severability

If any provision is found unenforceable, the remaining provisions will continue in full force.

15.4 Waiver

Our failure to enforce any right or provision is not a waiver of that right or provision.

15.5 Assignment

You may not assign these Terms without our written consent. We may assign our rights to any successor or acquirer.
